Washington, D.C. — El gobierno de Estados Unidos presentó una propuesta para restablecer una versión más estricta de la política conocida como “carga pública” (public charge), una medida que podría influir en la aprobación de solicitudes de residencia permanente para algunos inmigrantes que reciben determinados beneficios de asistencia gubernamental.
De acuerdo con la propuesta, las autoridades migratorias evaluarían si un solicitante tiene probabilidades de depender de programas de asistencia pública en el futuro. Para ello, analizarían diversos aspectos, entre ellos la edad, el estado de salud, el nivel de ingresos, la educación, el historial laboral y la capacidad económica del solicitante.
Es importante destacar que el uso de beneficios públicos no implicaría automáticamente el rechazo de una solicitud de residencia permanente. En cambio, sería uno de varios factores considerados durante la evaluación integral de cada caso.
La administración estadounidense sostiene que la medida busca reforzar el principio de autosuficiencia económica establecido en la legislación migratoria y garantizar que quienes obtengan la residencia permanente puedan mantenerse sin depender de manera significativa de recursos financiados por los contribuyentes.
La propuesta revive una política aplicada durante el primer mandato del presidente Donald Trump, la cual amplió los programas de asistencia pública que podían ser considerados bajo la regla de “carga pública”. Esa política fue posteriormente modificada por la administración del presidente Joe Biden, que redujo el alcance de los beneficios tomados en cuenta durante el proceso migratorio.
Diversas organizaciones defensoras de los derechos de los inmigrantes expresaron su preocupación por la iniciativa. Washington, D.C. — The U.S. government has proposed reinstating a stricter version of the “public charge” policy, a measure that could influence whether some immigrants qualify for lawful permanent residency if they receive certain government assistance benefits.
Under the proposal, immigration officials would evaluate whether a green card applicant is likely to rely on public assistance in the future. Factors such as age, health, income, education, employment history, financial resources, and family circumstances would all be considered during the review process.
Importantly, receiving government benefits would not automatically result in a green card denial. Instead, it would be one of several factors considered as part of an overall assessment of each applicant.
The administration says the proposal is intended to reinforce the long-standing principle that immigrants seeking permanent residency should be financially self-sufficient and less likely to depend on taxpayer-funded assistance.
The proposal revives a policy first introduced during President Donald Trump’s first term, which expanded the types of public benefits that could be considered under the public charge rule. That policy was later narrowed by the Biden administration, which limited the benefits immigration officials could consider during residency evaluations.
Immigrant advocacy groups have criticized the proposal, arguing that it could discourage eligible families from seeking essential services such as healthcare, food assistance, or housing support out of fear that doing so could affect their immigration status—even when they legally qualify for those programs.
Supporters of the proposal argue that it strengthens immigration law and promotes financial responsibility among those seeking to become permanent U.S. residents.
